1. Agreement to Terms

These Terms of Service (the "Terms") constitute a legally binding agreement between you and FishForge LLC ("FishForge," "we," "our," or "us") governing your access to and use of the website at fishforge.io and any related applications, features, content, and services (collectively, the "Service").

By accessing or using the Service, or by creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference. Together, these Terms and the Privacy Policy form the entire agreement between you and FishForge regarding the Service, except as otherwise stated herein.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

Certain features require an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

We may refuse registration, reclaim usernames, or require verification at our discretion. You may not share your account or use another person's account without permission.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms
Abuse, harass, threaten, or harm other users or FishForge
Attempt to gain unauthorized access to the Service, accounts, systems, or networks
Interfere with or disrupt the Service, including by introducing malware or overloading infrastructure
Mine, harvest, scrape, or otherwise collect User Content (as defined below) for artificial intelligence training, machine learning, bulk resale, or similar data-mining purposes
Misrepresent your identity or affiliation, or submit false or misleading information
Violate the intellectual property or other rights of FishForge or any third party

Lawful scraping of publicly available, non-personal Site content (such as public catalog pages and public guides) is permitted, provided you do not circumvent access controls, impair the Service, collect personal information, or mine User Content as prohibited above.

5. User Content

"User Content" means content you submit, upload, create, or store through the Service, including saved builds, fishing spots, gear submissions, messages, profile information, and similar materials.

You retain ownership of your User Content. You grant FishForge a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your User Content solely as needed to operate, provide, secure, and improve the Service (for example, to save and show your builds or process submissions).

FishForge will not sell or license your User Content for artificial intelligence training or similar data-mining. You represent that you have all rights necessary to submit User Content and that it does not violate law or third-party rights.

We may remove or restrict User Content that we believe violates these Terms or applicable law, or that poses a risk to the Service or others.

6. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other FishForge materials (excluding User Content and third-party materials), is owned by FishForge LLC or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

Product names, logos, and trademarks of gear manufacturers and other third parties remain the property of their respective owners. Reference to third-party brands does not imply endorsement.

7. Affiliate Links and Third-Party Services

FishForge participates in the Amazon Associates Program and may include affiliate links. We may earn a commission from qualifying purchases at no additional cost to you. Prices, availability, product details, and fulfillment are controlled by third parties and may change without notice.

The Service may link to or integrate third-party websites, products, or services. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

8. No Professional Advice; Informational Only

Compatibility suggestions, gear information, guides, weather-related features, and similar content are provided for general informational purposes only. They are not professional, safety, or purchasing advice, and they do not guarantee fitness for any particular purpose, catch results, or outcomes. You are solely responsible for verifying product specifications, compatibility, and suitability before purchase or use.

9. Service Changes and Availability

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Features may change as we improve the product.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHFORGE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE JURISDICTIONS, THE ABOVE DISCLAIMERS APPLY TO THE FULLEST EXTENT PERMITTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHFORGE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID TO FISHFORGE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND FISHFORGE.

12. Indemnification

You agree to defend, indemnify, and hold harmless FishForge LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your infringement of any third-party right. We may assume the exclusive defense of any matter subject to indemnification at your expense, and you agree to cooperate with our defense.

13. Termination and Suspension

We may suspend, restrict, or terminate your access to the Service or your account at any time, for any reason or no reason, with or without notice, including if we believe you have violated these Terms.

You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification, dispute resolution, and general terms) will survive termination.

15. Governing Law

These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles. Subject to the arbitration provisions below, exclusive venue for any permitted court proceedings will be the state courts located in Antrim County, Michigan, or the United States District Court for the Western District of Michigan, and you consent to personal jurisdiction in those courts.

16. Dispute Resolution; Arbitration; Class Action Waiver

Informal resolution. Before filing a claim, you agree to contact us at info@fishforge.io and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. Except for disputes that qualify for small claims court or claims for injunctive or equitable relief relating to intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be seated in the State of Michigan. Judgment on the award may be entered in any court of competent jurisdiction.

Small claims carve-out. Either party may bring an individual action in small claims court of competent jurisdiction for disputes that qualify.

Class action waiver. YOU AND FISHFORGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court rather than arbitration. If the arbitration agreement is found unenforceable in its entirety, the exclusive venue provisions in Section 15 will apply.

17. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the Effective Date. Material changes will be indicated by updating the Effective Date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

19. General

Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Entire agreement. These Terms, together with the Privacy Policy and any additional terms we expressly incorporate, constitute the entire agreement between you and FishForge regarding the Service and supersede prior or contemporaneous agreements on the subject.

Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction. These Terms bind and benefit permitted successors and assigns.

Survival. Provisions that by their nature should survive termination will survive, including Sections 5–8 and 10–19.
